Terms of use

The terms for using TrackPostcode.UK.

These terms of use ("Terms") govern your access to and use of trackpostcode.uk (the "Site"). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Information only, not advice

All scores, reports, rankings, calculators and other content on the Site are provided for general information purposes only. Nothing on the Site constitutes, or is intended to constitute, financial, investment, mortgage, legal, tax, property, relocation or any other form of professional advice, and no content should be relied upon as such. The affordability calculator produces illustrative estimates from simplified assumptions and is not a lending decision, offer or recommendation. TrackPostcode.UK is not authorised or regulated by the Financial Conduct Authority and does not provide regulated financial services; always obtain independent professional financial advice. You should verify all figures against the linked primary sources and obtain independent professional advice before making any decision, including any decision to move home, purchase property or enter into any financial commitment.

2. Data and accuracy

Content is derived from third-party open datasets which may be incomplete, delayed, superseded, inaccurate or withdrawn without notice. Scores are the output of a published methodology applied to available data and are inherently subjective and partial; a report may be based on only some of the categories the methodology covers, as indicated by its completeness figure. We make no representation, warranty or guarantee, express or implied, as to the accuracy, completeness, currency, reliability or fitness for any particular purpose of any content on the Site, all of which is provided "as is" and "as available".

3. Intellectual property

The Site design, code, scoring methodology, text and compilation of data are owned by us or our licensors. Underlying open data remains subject to its original licence (including the Open Government Licence v3.0 and the Open Database Licence), and nothing in these Terms restricts rights granted by those licences. You may view and print pages for personal, non-commercial use. Any other reproduction, redistribution or commercial exploitation of Site content requires our prior written consent.

4. Acceptable use

You must not: (a) scrape, crawl, harvest or bulk-download the Site or its data by automated means without our prior written permission; (b) take any action that imposes an unreasonable load on our infrastructure or interferes with the proper working of the Site; (c) attempt to gain unauthorised access to any part of the Site or its systems; (d) use the Site for any unlawful purpose or in breach of any applicable law or regulation; or (e) misrepresent Site content as your own or as endorsed by us.

5. Third-party sites and services

The Site links to third-party websites and datasets. We do not control and are not responsible for their content, availability, terms or privacy practices. Links are provided for convenience and attribution only and do not imply endorsement.

6. Availability and changes

We do not guarantee that the Site will be available, uninterrupted or error-free. We may modify, suspend or withdraw the Site, any feature, any score, the methodology, or these Terms at any time without notice. Continued use of the Site after changes to these Terms constitutes acceptance of the revised Terms.

7. Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Subject to that, to the maximum extent permitted by law: (a) we exclude all implied conditions, warranties and representations; (b) we shall not be liable for any loss or damage, whether direct or indirect, including loss of profit, loss of opportunity, loss of data, or any financial or property loss, arising out of or in connection with your use of, or inability to use, the Site or reliance on any content on it, whether in contract, delict (including negligence), breach of statutory duty or otherwise, even if foreseeable; and (c) our total aggregate liability to you in connection with the Site shall not exceed one hundred pounds sterling (£100).

8. Indemnity

You agree to indemnify us against all claims, liabilities, costs and expenses arising from your breach of these Terms or misuse of the Site.

9. Privacy and cookies

We process personal data in accordance with the UK General Data Protection Regulation, the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2003 and, for visitors in the European Economic Area, the EU General Data Protection Regulation. How we do so is set out in our privacy and cookie policy, which forms part of these Terms. Essential cookies are set because the Site cannot work without them. Optional cookies, such as analytics, are set only with your consent, which you may give, refuse or withdraw at any time through the cookie settings link in the footer of every page. Refusing optional cookies does not limit your use of the Site.

10. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force. A failure to enforce any provision is not a waiver of it. These Terms, together with the privacy and cookie policy, constitute the entire agreement between you and us regarding use of the Site.

11. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Site, are governed by the law of Scotland, and the Scottish courts have exclusive jurisdiction, save that nothing prevents consumers from relying on mandatory protections of the law of their country of residence within the UK or the European Economic Area.
